Assembly Bill 46 of the 2009 Nevada Legislative
session amended NRS 174.035 to mandate that courts report adjudication of
mental illness or incompetence, involuntary admission to mental health
facilities and other records which indicate a person is prohibited from
purchasing a firearm to the Nevada Department of Public Safety, General
Services Division for entry into the National Instant Criminal Background Check
System (NICS) database.
Senate Bill No. 240 of the 2015 Nevada Legislative
session further amended NRS 174.035, effective October 1st, 2015, to
state “If the court accepts a plea of guilty but mentally ill pursuant to this
section, the court shall cause, within 5 business days after acceptance
of the plea, on a form prescribed by the Department of Public Safety, a
record of that plea to be transmitted to the Central Repository for Nevada
Records of Criminal History along with a statement indicating that the record
is being transmitted for inclusion in each appropriate database of the National
Instant Criminal Background Check System. “
Assembly Bill No. 253
of the 2017 Nevada Legislative session amended NRS 433A.310(7) to provide that
“If the court issues an order involuntarily admitting a person to a public or
private mental health facility or to a program of community-based or
outpatient services,” this information must
be transmitted to the Central Repository
for Nevada Records of Criminal History and
“(b) Each law enforcement agency of this State with which the court has entered
into an agreement for such transmission, along with a statement indicating that
the record is being transmitted for inclusion in each of this State’s
appropriate databases of information relating to crimes.”
